Please read this privacy policy (“Privacy Policy”) carefully before using the website https://www.spectx.com/ and any of its subdomains, if applicable, (“Website”) or concluding an End User Licence Agreement with Spectx OÜ (“we”, “us” or “our”) for the use of the “Spectx” software (“EULA”). This Privacy Policy is applicable to the use of the Website and to the conclusion, performance and execution of the EULA. This Privacy Policy refers to you, the user of the Website and/or a party to the EULA, as “you” or “your”.

1. PERSONAL DATA WE COLLECT AND PROCESS

       1.1.1 upon the conclusion of the EULA we collect the following personal data:
              1.1.1.1 Your first and last name;
              1.1.1.2 Your e-mail address;
       1.1.2 any correspondence (including any personal information retained in such correspondence) exchanged between you and us;
       1.1.3 any data, device or software related, that has been given by you to us when you have reported a problem with any software we have licenced to you;
       1.1.4 any data that has been forwarded to us or has become known to us by providers of billing services or banks;
        1.1.5 any data, device or software related, that has been given and/or sent by you, or by your device, to us via using the Website, including but not limited to:
               1.1.5.1 IP address of your device;
               1.1.5.2 user-agent;
               1.1.5.3 http-referrer;
               1.1.5.4 web browser used;
               1.1.5.5 SpectX installation identifiers;
               1.1.5.6 server log information (the date and time of visit, pages viewed, time spent on the Website, etc.).

  2.1 We are using cookies on our Website to analyse user-generated traffic, as well as enhance and optimize the user experience offered by our Website.        3.1.2. diagnosing and repairing problems with the Website;
       3.1.3 for concluding the EULA and for ensuring the performance of the EULA;
       3.1.4 maintaining necessary communication with you;
       3.1.5 billing you for the use of our software solutions.

4. METHODS OF PROCESSING PERSONAL DATA 
  4.1 We only process the personal data submitted by you prior to the conclusion of the EULA, collected from third party service providers related to billing purposes and collected from you in relation to the use of the Website.
  4.2 We retain the personal data collected for the processing purposes indicated in Section 3 of this Privacy Policy.

5. SECURITY AND RETENTION OF PERSONAL DATA 
  5.1 All the collected personal data is stored in the data centres located on the territories of EU Member States.
  5.2 Only our authorized employees have access to the personal data and they may access the data only for the purpose of resolving issues associated with the use of the Website and for any issues relating to the EULA.
  5.3 Data regarding the correspondence or notices between us and you and any technical data is retained no longer than for 3 years from the creation of such data. Any other personal data is retained as long as any claims can be submitted on the basis of such data or in relation to such data. Data processed in relation to accounting documents is retained for 7 years.
  5.4 Please note that we may also be under additional obligations to retain certain data concerning you under applicable legislation.

6. SHARING THE PERSONAL DATA

        6.1.2 in order to enforce the EULA or any other agreements concluded between you and us;
        6.1.3 to third party service providers for billing purposes;
        6.1.4 to our lawyers, auditors and attorneys, who are not entitled to disclose your personal data;
        6.1.5 where we share data with a third party to enhance, develop, execute or analyse our Website and in order to ensure the performance of the EULA, such third party service providers shall be considered data processors in relation to your personal data. 
  6.2 We note that we are not, under no circumstances, selling your personal data to third parties without your prior consent.

7. YOUR RIGHTS
  7.1 You have the right to access your personal data processed by us and may demand the correction of inaccurate personal data.
  7.2 If the processing of personal data is not allowed under applicable law, you have the right to demand the termination of the processing of the personal data, termination of the disclosure of the personal data and closure or deletion of personal data processed.
  7.3 You have the right of recourse to the Data Protection Inspectorate or a court if you find that your rights are violated in the processing of personal data, unless a different procedure for contestation is provided under applicable legislation.
  7.4 If your rights have been violated upon processing of personal data, you have the right to demand compensation for the damage caused to you.

8. OTHER
  8.1 We have the right to unilaterally modify the Privacy Policy from time to time. The latest version of the Privacy Policy is always accessible on the Website.
